Sir, my father aged 92 years was effected with rt (p) i.c.h. (intra cranial hemorrhage) on dt 31-8-2015. His treatment for brain hemorrhage was done in sai hospital haldwani (nainital) from dt 1-9-2015 to 10-9-2015. In the condition of above brain hemorrhage he had executed a registered gift deed of his agriculture land in favour of his married daughter's son on dt 28-5-2016, by neglecting his sucsesor ie only one son. Kindly intimate that in the condition of my father's above said brain hemorrhage attack on dt 31-8-2015 & no reviews was done time to time after dt 10-9-2015 & his regular treatment was discontinued for his i.c h. Treatment, whether his mind will be treated as good, sound & in healthy state to execute a registered gift deed in registrar office & whether if this gift deed is executed in his after brain hemorrhage condition, then whether this executed gift deed will be treated illegible in the eye of law or it may be challenged in civil court for it's cancellation & declayering it null & void in the eye of court. The death of my father was occurred in the age 95 years on dt 09-2-2018. Thanks. Girish kumar khulve.

If the consciousness was damaged or he was not in his senses at the time of making the deed, it can be challenged and annulled by the court of law. The onus of proving that he as not in his full consciousness or was in uncerttain mind is there on the one who challenges the partition deed. If you can make sure if he physically went to the registrar's office the mental and physical state can be clearly explained.
